PERSONAL DATA PROTECTION LAW DISCLOSURE STATEMENT

In accordance with the provisions of the Personal Data Protection Law No. 6698 (KVKK), any information that identifies or makes your identity identifiable is considered Personal Data and will be processed by Güngörpen PVC Industry and Trade Ltd. Co., acting as the Data Controller, within the scope described below. “Processing of Personal Data” refers to any operation performed on such data, including collection, recording, storage, preservation, modification, reorganization, disclosure, transfer, acquisition, making available, classification, or prevention of use.

The Personal Data Protection Law No. 6698 was published in the Official Gazette dated 04/07/2016 and numbered 29677 and has entered into force. If personal data was lawfully obtained by our company prior to the effective date of this Law, such data will be processed and stored in accordance with this Disclosure Statement and the conditions set forth in the KVKK.

As Güngörpen PVC Industry and Trade Ltd. Co., we attach the highest level of importance to the security of your personal data and would like to emphasize that we continue our operations with the awareness that the protection of your personal data is a top priority in all the services we provide.

During the use of your personal data within our services, protecting the privacy of your private life and your fundamental rights and freedoms is our core principle.

Purposes and Legal Grounds for Processing Your Personal Data:
Your personal data, including identity information, address, phone number, tax number, and other data defined as personal data under KVKK, may be processed in order to provide our services in compliance with the applicable laws and regulations, to carry out our business operations, to identify the parties involved in transactions, to prepare documents and records for transactions conducted in physical or electronic environments, to fulfill our obligations of information retention, reporting, and disclosure to judicial and administrative authorities as required by law, and to provide other services offered or requested by our company.

Pursuant to Article 5/2 of KVKK titled “Conditions for Processing Personal Data,” personal data may be processed without the explicit consent of the data subject if at least one of the following conditions is met:
a. It is explicitly stipulated by law.
b. It is necessary to protect the life or physical integrity of a person who is unable to provide consent due to actual impossibility or whose consent is not legally valid.
c. It is necessary to process personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of the contract.
d. It is necessary for the data controller to fulfill its legal obligations.
e. The data has been made public by the data subject.
f. It is necessary for the establishment, exercise, or protection of a legal right.
g. It is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Transfer of Your Personal Data:
Even without the explicit consent of the data subject, personal data may be transferred to third parties by our Company by taking all necessary security measures, including those prescribed by the Board, if one or more of the following conditions exist:
a. The relevant activity regarding the transfer of personal data is explicitly stipulated by law,
b. The transfer of personal data by the Company is directly related and necessary for the establishment or performance of a contract,
c. The transfer is necessary for the Company to fulfill its legal obligations,
d. The personal data has been made public by the data subject, limited to the purpose of such disclosure,
e. The transfer is necessary for the establishment, exercise, or protection of the rights of the Company, the data subject, or third parties,
f. The transfer is necessary for the legitimate interests of the Company, provided that it does not harm the fundamental rights and freedoms of the data subject,
g. It is necessary to protect the life or physical integrity of a person who is unable to provide consent due to actual impossibility or whose consent is not legally valid.

In addition, personal data may be transferred to foreign countries declared by the Board as having adequate protection (“Foreign Country with Adequate Protection”) if any of the above conditions are met. In cases where adequate protection is not available, data may be transferred to foreign countries where data controllers in Turkey and in the relevant foreign country commit in writing to provide adequate protection and where the Board’s approval is obtained (“Foreign Country with Data Controller Providing Adequate Protection”).

Deletion, Destruction, or Anonymization of Personal Data:
Although processed in accordance with this Law and other relevant legislation, personal data shall be deleted, destroyed, or anonymized by the data controller ex officio or upon request of the data subject when the reasons requiring its processing cease to exist.
b. Provisions in other laws regarding the deletion, destruction, or anonymization of personal data are reserved.
c. Procedures and principles regarding deletion, destruction, or anonymization of personal data shall be regulated by regulation.

Your Rights Under Article 11 of the Law:
By applying to our Company, you have the right to:
a. Learn whether your personal data is being processed,
b. Request information if your personal data has been processed,
c. Learn the purpose of processing and whether it is used in accordance with that purpose,
d. Know the third parties to whom your data is transferred domestically or abroad,
e. Request correction if your personal data is incomplete or incorrectly processed,
f. Request deletion or destruction of your personal data within the framework of the conditions set forth in the KVKK,
g. Request notification of the transactions made pursuant to subparagraphs (e) and (f) to third parties to whom your data has been transferred,
h. Object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems,
i. Request compensation for damages in case you suffer damage due to unlawful processing of your personal data.
